General Inspector of Public Administration Decisions Questioned as His Term in Office has Ended

rakintzisThe plenary session of the State Council will decide whether the General Inspector of Public Administration Leandros Rakintzis remains legally in his position and issues administrative acts despite the fact that his term ended in September 2009.
Rakintzis became General Inspector of Public Administration in 2004. His term ended in September 2009. He remained in his position silently as no government since then has replaced him or officially renewed his term.
In judging cases of civil servants who appealed against decisions of Rakintzis, the C-section of Greece’s Supreme Administrative Court held that since his term in office has ended, he does not have the authority to appeal against final decisions of disciplinary councils.
The ruling vindicates civil servants who have appealed against decisions of the General Inspector from 2009 until today. Now it is up to the Council of the State Plenary to decide whether Rakintzis’ decisions will still hold.
At the end of 2015, the C-section of the State Council ruled in favor of several civil servants who had gone through disciplinary councils and Rakintzis had asked for stiffer penalties for their actions. Thereby, the legality of his decisions is now under question.
